Terms of Service

These Terms of Service ("Terms") govern your use of the Cognico mobile application and the cognico.app website (together, the "Service"), operated by the Cognico team ("Cognico", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. What Cognico is — and what it is not

Cognico is a day-planning app designed with ADHD-friendly principles: time clusters, small task pools, focus sessions and reminders. Cognico is a productivity tool, not a medical product. It is not a medical device, does not diagnose, treat, cure or prevent ADHD or any other condition, and is not a substitute for professional medical advice. Always seek the advice of a qualified health provider with questions about a medical condition.

2. Eligibility and accounts

You must be at least 13 years old (or the higher minimum age required for consent to data processing in your country) to create an account. You may sign up with an email address and password, or through Sign in with Apple or Google. You are responsible for keeping your credentials secure and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorized use.

3. Your content

Everything you create in Cognico — clusters, pools, tasks, reminders, notes and settings — is your content. You retain all rights to it. You grant us only the limited license needed to store, sync and display that content back to you across your devices. We do not use your content for advertising and we do not sell it.

4. License to use the Service

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse-engineer or attempt to extract the source code of the Service, except where such restriction is prohibited by law or permitted by the license terms of the open-source components the app is built with.

6. Subscriptions and free tier

Cognico offers a free tier and an optional auto-renewing subscription ("Cognico Pro"). Billing is handled entirely by Apple's App Store or Google Play. The full terms — prices, trial, renewal and cancellation — are described in our Subscription terms, which form part of these Terms.

How we collect and handle personal data is described in our Privacy Policy.

8. Intellectual property

The Service — including the Cognico name, logo, design, artwork and software (excluding your content and third-party open-source components) — is owned by Cognico and protected by applicable intellectual-property laws.

9. Termination

You can stop using the Service and delete your account at any time in the app (Profile → Account → Delete account); this permanently removes your account and synced data. We may suspend or terminate your access if you materially breach these Terms, with notice where practicable.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that data loss will never occur — please keep independent copies of information that is critical to you.

11. Limitation of liability

To the maximum extent permitted by law, Cognico shall not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data or goodwill, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months before the event giving rise to the claim (or US $10 if you have not paid anything). Nothing in these Terms limits liability that cannot be limited by law, including for a consumer's statutory rights.

12. App-store terms

If you downloaded the app from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple is not responsible for the Service or claims related to it. If you downloaded the app from Google Play, the Google Play Terms of Service also apply. In case of conflict regarding billing, the store's terms prevail.

13. Changes to the Service or these Terms

We may update the Service and these Terms from time to time. For material changes we will give notice in the app or by email before the changes take effect. Continuing to use the Service after the effective date means you accept the updated Terms.

14. Governing law

These Terms are governed by the mandatory consumer-protection laws of your country of habitual residence. Any disputes will be resolved in the competent courts of that jurisdiction unless applicable law provides otherwise.
